Terms of Use

Use of these scales requires permission from Dr. Goodman. A paid licensing agreement is required for:

• Commercial use, including in industry-sponsored clinical trials;
• Incorporation into an electronic health record (EHR);
• Inclusion in an app; and
• Any other form of digitalization – this includes using ambient AI during administration of a paper version of the scales to generate a digital record for inclusion into an EHR. Making a digital version of a copyrighted paper document is, at its core, an act of reproduction—one of the exclusive rights enumerated under 17 U.S.C. § 106. Without authorization from the rights holder, digitizing a copyrighted work can constitute infringement.

Non-Commercial Use Terms

Non-commercial clinical or research use of the paper (hard copy) versions of the scales requires permission from Dr. Goodman. If granted permission, the clinician agrees to abide by the following terms of use:

1. No Unauthorized Commercial Use: The Measures are provided strictly for non-commercial clinical practice or academic research use. Any use for commercial purposes—including, but not limited to, industry-sponsored clinical trials, for-profit healthcare systems, or commercial products—requires a separate commercial license from OCD Scales, Inc.
2. No Digitalization or Software/App Integration: You agree not to digitize, convert, adapt, or
   integrate the Measures into any software, web application, mobile app, ambient AI technology, or
   Electronic Health Record (EHR) system without explicit, prior written authorization from OCD Scales,
   Inc.
3. No External Distribution: You may not redistribute, share, transfer, or sublicense the Measures to any
   third parties.
4. No Public Posting: The Measures must not be hosted, posted, uploaded, or made accessible on
   any publicly facing website, open-access repository, cloud drive, or social media platform.
5. No Publication or Reprinting: You may not publish, reprint, or reproduce the Measures in whole or
   in part in any book, journal, article, or website. Publication of brief excerpts for academic discussion
   requires prior written review and approval by OCD Scales, Inc.
6. Organizational Scope: Permission to use the Measures is granted strictly on an individual basis to
   the authorized clinician or user. Other members of your immediate clinical team, colleagues, or
   associated personnel may not use the Measures under your authorization; they must obtain separate
   individual permissions or be explicitly covered under an executed organizational agreement signed
   by an authorized representative of their institution.
7. Translation Restrictions: Unauthorized translations or cross-cultural adaptations are strictly
   prohibited. Translations are permitted solely upon advance approval and must be developed in
   accordance with official translation guidelines. OCD Scales, Inc. retains exclusive copyright and
   intellectual property rights over all translated or adapted versions.
8. Copyright Notice Preservation: You must ensure that the official copyright notice and proprietary
   markings remain legible and intact on all permitted physical or digital copies of the Measures.
9. No Adaptations or Modifications: No alterations, additions, deletions, reformatting, or structural
   adaptations of the Measures (including item wording, scoring methodology, or response options) are
   permitted.
10. Citation Requirement: You must properly cite the relevant primary publication(s) in any journal
    article, presentation, report, or published work that utilizes data or findings derived from the
    Measures.
11. Termination of Authorization: Any violation of these terms immediately and automatically
    terminates your authorization to use, store, or display the Measures. Upon termination, you must
    immediately cease all use and permanently destroy or delete all physical and digital copies of the
    Measures in your possession or control. OCD Scales, Inc. reserves all legal remedies available for
    unauthorized use or infringement.
